"Administration Fee" means the amount You are charged by RQ in order to cover administrative expenses, when playing a skill game on the Site for money.
"Force Majeure" means an event which is beyond the control of RQ to include, acts of God, governmental act, war, fire, flood, explosion or civil commotion, telecommunications or computer system failures, delays or interruptions, the inability to obtain supplies and/or any circumstances and/or events caused by or arising out of any acts and/or omissions of You and/or any third parties;
"IPR" means all intellectual property rights wherever in the world arising, whether registered or unregistered (and including any application), including copyright,(including "look and feel"), know-how, confidential information, trade secrets, business names and domain names, trade marks, service marks, trade names, patents, petty patents, utility models, design rights, semi-conductor topography rights, database rights and all rights in the nature of unfair competition rights or rights to sue for passing off;
"Site" means the quiz site (and/or any part of it) which can be accessed at the following pages: www.royalquiz.com; www.royalquiz.co.uk; and www.royalquiz.se;
"Terms and Conditions" means the terms and conditions presented below; and
"You" means you, the participant or member

1. Background
1.1 RQ Games AB, a Swedish company with registration number 556691-7547, ("RQ") welcomes You to RQ's site. The Terms and Conditions describe Your and RQ's rights and obligations regarding the "Site" and the services and products that are presented by RQ, and its subsidiaries.
1.2 The Terms and Conditions do not constitute a contract for work or employment. When registering for the services presented at this Site You shall accept the Terms and Conditions. When You return to the Site, You will not be asked to approve to the Terms and Conditions since You already have done so before, and they automatically are active. You find the Terms and Conditions under the Help section.
1.3 If You do not accept the Terms and Conditions You must not and should not use this Site. RQ may, at any time, change the Terms and Conditions for this Site. The new Terms and Conditions will be presented on the Site ahead of their implementation. You automatically approve of changes to the Terms and Conditions by using the Site.

2. About the Site
2.1 On this Site RQ offers quizzes where You can compete against other members. RQ's quizzes are games based on skill in various areas and in various game formats.
2.2 RQ's games are so called skill games where it is the players' skill that determines the winner. All participants compete under the same conditions and the participant who performs best is the winner. On this Site You can also create Your own quizzes that other visitors to RQ can participate in, so called user generated quizzes. Read more under heading number 9.

3. Usage of the Site
3.1 In quizzes on the Site where participants do not compete for money or other prizes, there are no participant age restrictions nor any restrictions on the countries or territories from which you can access the Site. In order to participate in quizzes where participants can win money or other prizes, You must be at least 18 years old.
3.2 In order to use the Site and its services where there are money or other prizes available to win,You have You must obey to the laws that apply to You in the country and/or state from which You access the Site. If a law prevents You from using the Site, You cannot use the Site. You give RQ the right to control from which country and/or state You use the Site. RQ has the right to and may block Your access to the Site at any time. It is Your responsibility to make certain that the laws that are applicable in the country and/or state where You reside, allow You to use the Site.
3.4 Usage of the Site is at Your own risk. RQ is not responsible for the functionality of Your software or hardware when using the Site, or Your connection to the Internet. RQ shall use reasonable endeavours to ensure that the Site is available, but at certain periods and/or times the Site may not be available to You. RQ is not responsible for any loss, injury or damages that You may suffer due to any such periods of Site inaccessibility.
3.5 RQ may update, modify and change the Site from time to time without any notice to You. RQ may also change the Site from time to time in order to cater for any legislative changes (including restricting or denying access to the Site to You, some or all members and/or any third parties).
3.6 These terms and conditions relating to the Site may be changed by RQ from time to time without notice to You. It is Your responsibility to check these terms and conditions before using the Site and to only use the Site if you agree to these terms and conditions.

4. Membership and Registration
4.1 In order to be able to use the Site You have to register. When You register You agree to the Terms and Conditions and become a member of the Site. Non-members may access the Site as guests, but they may then only try selected services. In order to be able to use the Site to its full extent You have to register.
4.2 When you register, You receive an account. You may only have one account ("Your Account") on RQ. You guarantee, warrant and representthat the information You supply when registering are Your own details and that they are correct, accurate, complete and up to date. You must not use the Site by using someone else's account and You are the only person that is entitled to use Your account and You must not let any other person use Your account. You must not open more than one account (neither in Your name nor in any other). If You misuse Your account then RQ has the right to and may at anytime suspend You from the Site and de-register Your membership. RQ will transfer any assets or credit from Your account back to you after deducting the Administration Fee.
4.3 When You register, You shall choose a username and password. You are responsible for all actions with Your username and password. RQ recommends that You keep username and password safe so that unauthorised individuals do not gain access to them. You must not sell, disclose or transfer username or password to other persons or allow other persons to use them. RQ is not responsible for damage, loss or injury that You suffer as a result of Your handling of username and passwords, or Your overall usage of the Site. You may not choose a username that RQ believes in its opinion is offensive, abusive or inappropriate in any way. If Your account is inactive for more than sixty (60) consecutive days and You, during that period, have not had more than 50 SEK on Your account, RQ has the right to close Your account, de-register Your membership and transfer the money on Your account to You after deduction of the Administration Fee.
4.4 You agree not to
(a) use any offensive, abusive, obsence, blashphemous or aggressive language; and/or
(b) provide any misleading, untrue or inaccurate information (and/or any information which is designed to facilitate any unauthorised activities)
in the short message service or other functions on the Site. RQ has the right to close Your account and de-register Your membership if RQ is of the opinion that You are in breach of this provision. RQ will then transfer the money on Your account to You after deducting the Administration Fee.
4.5 Staff at RQ or persons with a professional relationship with RQ may use RQ only in order to test or improve the user experience BUT these persons may not deduct money or other prizes from their account on the Site.

5. Funds on Your account (only applicable to players who can play skill games on the Site for money)
5.1 You must transfer enough funds to Your account in order to be able to pay the Administration Fee that is required to play quizzes where You can win money or other prizes. Deposits to Your account can be made through PayPal or other transaction services presented on the Site. The funds in Your account are deposited in a bank or at PayPal. No sum will be paid to You in respect of any intereston any monies which You deposit in your account or in relation to the Site. .
5.2 When registering on the Site, You may obtain a discount (at RQ's sole discretion) for depositing money on Your account. You may only participate in quizzes that cost money if in RQ's opinion You have substantial or enough funds on Your account. If You choose not to start a quiz, no Administration Fee will be deducted from Your account.
5.3 It is up to You to ensure that the quiz that You have taken and the transaction around it are performed correctly and that You promptly report any errors or complaints to RQ. If You do not report an error or complaint within a reasonable time (being no later than the earlier of 30 days from the time that the error arose or 30 days from from the date that You should became aware of it or should reasonably have become aware of it) otherwise You lose the right to pursue the issue against RQ. In the case that RQ by mistake have deposited funds to Your account, RQ shall have the right to and will take those funds back.
5.4 Withdraws from Your account are made on the Site and through the transaction services of the Site. If You choose to terminate Your account, the funds on Your account, after deduction of Administration Fee, will be paid to You by PayPal.

6. The structure of the quizzes
6.1 The structure of the quizzes is described under the Help section. The rules of the quizzes are provided by RQ and are presented next to every quiz. It is Your responsibility to ensure that You have read and understood the rules of the quiz. Questions and comments about the quiz should be submitted by the "Contact us" instructions on the Site.
6.2 You are responsible for abiding by the rules of the quizzes. The rules can be changed and new quizzes can be added. You must not cheat (or attempt to cheat in any way) or try to evade the structure of the quizzes. You agree not to co-operate with other participants in order to gain advantages that may affect the outcome of the competition. You may not use any form of software or robot to assist You in playing the quizzes or using the Site.
6.3 RQ is not, under any circumstances, responsible for loss, damages, injury or costs that may be the result of illegal gaming or any other gaming that breaks the rules of the quizzes. Misuse will lead to suspension of You from the Site and de-registration of Your membership. Winnings that have been gained through any breach of the previous paragraph, shall be kept in Your account while an investigation is carried out by RQ. RQ has systems that ensure that participation in the quizzes is fair and correct.

7. Winnings, fees for participation etc. (only for players who can play skill games on the Site for money)
7.1 It is the skill, a combination of knowledge and speed, of a participant that determines the outcome of the quiz. Rules for the quizzes are found under the Help section on the Site.
7.2 In a quiz where the participants can win money or other prizes, RQ shall take an Administration Fee for participation in the quiz, in accordance with section 8. The prize money or other prize is presented on the Site. In Tournaments the prize money is determined by the number of participants.
7.3 The outcome of a quiz is presented on the Site for all participants. Lists and ranking are also presented on the Site. Only Your username will be used in lists and ranking. A prize in the form of money will be deposited in the account of the winner straight away. Larger winnings may take longer to deposit in the winner's account.
7.4 Any amounts paid into Your account by mistake belong to RQ and must be returned as soon as possible and/or RQ will deduct such monies from Your account if it has sufficient funds. If You make a withdrawal of such a sum, You shall be deemed to hold the sum on trust for RQ and You are obliged to repay the full amount to RQ.
7.5 Any liability relating to You (including but not limited to any tax liabilities) as a result of You winning a prize is to be paid by You. RQ is not responsible for paying Your tax.
7.6 RQ is by Swedish law obliged to send information to the Swedish taxation authorities (Skatteverket) of every member who is a Swedish citizen and that has had winnings of over 100 SEK. This information will be sent no later than the 31st of January each year, and it contains Your personal registration number, Your winnings etc.
7.7 RQ will comply with the directions, regulations and/or instructions of any other relevant national tax authorities (in addition to the Swedish tax authorities) as from time-to-time relevant and as RQ, in its opinion, believes is necessary.

8. Fees (only for players that can play skill games on the Site for money)
8.1 RQ handles Your and every other participant's stake in a quiz game. In accordance with section 7, RQ takes an administrative fee for handling the quizzes.
8.2 In Duell and Speed, the administrative fee is a fixed amount that depends on the amount played for, and the fee is in addition to the amount that is played for. The fee is:
1 SEK for a game with a 5 SEK stake; or £0,1 for a game with a £0,4 stake,
2 SEK for a game with a 10 SEK stake; or £0.2 for a game with a £0.8 stake,
3 SEK for a game with a 20 SEK stake; or £0.3 for a game with a £1.6 stake,
5 SEK for a game with a 50 SEK stake; and £0.4 for a game with a £4 stake.
In Tournament, the fee is a fixed amount for non money prizes, normally 10 SEK or 20 SEK, or £0.80 or £1.60 and it is presented in relation to every Tournament.
8.3 In Tournaments where participants can win money, 75% of the fees are diverted to a pool of winnings that the participants compete for. You choose which competition You want to participate in.]
8.4 If you wish to withdraw funds from Your account, RQ shall charge the Administration Fee. Withdrawals that do not cover the amount will not be approved by RQ and will not be implemented by RQ.

9. User generated quizzes and widgets
9.1 On the Site there is a functionality that makes it possible for registered members to create quizzes by typing their own questions and answers. The user-generated quizzes can be placed by the member or by RQ on the Site and other sites as a widget.
9.2 The questions, answers or pictures that the member creates, uses and post in the user generated quizzes will be owned by the member, but the member gives RQ and its members a royalty free license to use the questions, answers and pictures without any conditions or limitations. The member approves of this by using the functionality that makes it possible for users to generate quizzes. A member will not receive any compensation for having generated a quiz or by placing the quiz as a widget. In user generated quizzes there will be no prizes.
9.3 The member is fully responsible for the questions and other material (including but not limited to ensuring that the questions and material are accurate, complete and up to date) that the member uses in his quiz and the member responsible for ensuring that no third party rights are violated. When the member uploads a picture the member must ensure that the member has copyright on the uploaded material, or the approval of the copyright owner. By creating questions, answers and uploading pictures the member hereby approves that users of RQ all have the right to use them and distribute them unconditionally and free of charge.
9.4 RQ is in no way responsible for any questions, answers and/or any other material or content present in the user generated quizzes. RQ has the right, at any time to contact the member and/or delete questions and material that RQ believes in its opinion are incorrect, inaccurate, incomplete and/or inappropriate in any way.
9.5 Members have the right to place user-generated quizzes on other places than on the Site, by the functionality called widget. RQ is not responsible for any damages that may occur as a result of this or for the approval from the place where the widget has been placed. It is the members' responsibility to ensure that the place where the quiz is places has approved that the user-generated quiz has been placed there. In all the user generated quizzes, even when they are placed as widgets outside of the Site, RQ has the right to and may present advertising for advertisers or other quizzes on the Site.

10. Material rights
10.1 Documentation, brands and other published and presented material including but not limited to software and contents on this Site belong to RQ or its subsidiary. All brands or distinguishing features on the Site, e.g. the logo of RQ, belongs to RQ or its subsidiaries. Non user-generated material that does not belong to RQ or its subsidiary is published with the approval of the owner of the rights and any such approval required by a member is hereby granted to RQ in these terms and conditions.
10.2 Printing, downloading or copying of content on this Site (and the Site itself) can only be made for private personal use and for any commercial use.
10.3 You understand and agree that all rights regarding information, technique, questions, answers, logo, brands and all other IPR as well as other commercial information regarding RQ and/or the Site, belongs to RQ. You agreenot to, in any way, use these rights in any undue or unauthorised manner or in any way which may cause any loss, damage or harm to RQ

11. Registration and the handling of personal information - Data Protection Policy
11.1 In order to be able to fulfill these Terms and Conditions, RQ must register and handle personal data. The information You give when registering (including but not limited to e-mail address and name) is likely to constitute personal information under the Data Protection Directive (EC Council Directive 95/46) and national implementing laws. Additional demographic and geographic information can be asked for but is voluntary to give.
11.2 In quizzes where You can win money additional information will be asked for, all information is stored and treated by RQ and/or its subsidiaries.
11.3 RQ undertakes to treat all Your information in accordance with all applicable obligations as Data Controller under the Data Protection Directive (EC Council Directive 95/46) and the Swedish national implementing laws. RQ will endeavour to keep accurate records of Your personal information and this shall only be retained as long as it is necessary in order to fulfil these Terms and Conditions.
11.4 Your personal information can be used by RQ and/or its subsidiary in order to present information to You through the Site or by e-mail. RQ normally uses e-mail to contact You. At any time You can contact RQ through the Contact us under the Help section or through the link in the e-mail, and tell RQ that You no longer wish to receive information.
11.5 By registration You approve to RQ, without limitation and compensation to You, presenting Your username on the Site and using your personal data in relation to the Site.
11.6 RQ uses cookies in order to improve Your usage of RQ. A cookie is a small data file that is saved in Your computer and that identifies Your computer when You visit RQs Site. RQ can then give You the best possible reception and improve Your usage of the Site.
11.7 You can always change Your personal information by visiting Your account on RQs Site. You can always, at any time, de-register from RQ, demand a correction of the personal information or ask questions concerning RQs policy by contacting us under the Contact us area under the Help section.

12. Limitations of RQ's Liability
12.1 RQ is not responsible for Site accessibility and RQ is not responsible for events that are outside RQ's control, including, without limitation, the result of the quizzes that You participate in, all the management of and equipment used by You, suppliers and middlemen or hardware and software that is used by RQ, as well as any events of Force Majeure. RQ is for example not responsible for Your Internet connection or for the capacity on Your computer being sufficient for using the Site. See Help on the Site for more information.
12.2 RQ tries to give as up to date and correct information as possible in the quizzes that RQ offers. However, all material on the Site is published and presented without any form of guarantees or promises by any form from RQ. RQ is not responsible for the information or other content on the Site, and offers and makes no representations and/or warranties that Site material in all parts is correct, accurate, complete and/or up-to-date.
12.3 RQ does not guarantee that this Site or material on the Site is free from computer viruses or other harmful components. You download and use of the Site is completely at Your own risk.
12.4 RQ shall not responsible or liable for the results or consequences of any events, situations or circumstances which are caused by You and/or any third parties.
12.5 RQ shall have no liability for any losses or damages which may be suffered and/or incurred by You (or any person claiming under or through You) and/or any third party that include:
(a) special damage even though RQ was aware of the circumstances in which such special damage could arise;
(b) loss of profits, loss of anticipated savings, loss of opportunity, loss of goodwill, loss of data or loss of time; and/or
(c) indirect or consequential losses or damages.
12.6 The total maximum aggregate liability of RQ, whether in contract, tort or otherwise and whether in connection with these Terms and Conditions and/or any collateral contract, shall in no circumstances exceed Eur1000.00 (one thousand Euros).
12.7 You acknowledge that no representations were made to You prior to accepting these Terms and Conditions. and You agree that, in accepting these Terms and Conditions, You did not rely on any representations (whether written or oral) of any kind or of any person other that those expressly set out in these Terms and Conditions.
12.8 You shall have no remedy in respect of any warranty or representation (whether written or oral) made to You on which You relied in accepting these Terms and Conditions which is not expressly set out in these Terms and Condtions and RQ shall have no liability otherwise than pursuant to the express terms of these Terms and Conditions.
12.9 The exclusions this section shall apply to the fullest extent permissible at law, but RQ does not and nothing in these terms and conditions shall exclude liability for death or personal injury caused by the negligence of RQ, its officers, employees, contractors or agents for fraud, breach of statutory obligations or other liability which may not be excluded or limited by law.
12.10 RQ is therefore not responsible for the correctness in the answers of the questions that appear in the quizzes on the Site. You agree to not make any claims or take any action against RQ for in relation to any answer not being correct, complete, accurate or up to date. You are however welcome to contact RQ and present the error so that RQ can investigate it. RQ shall not be responsible for any reliance that you may place and/or actions that you may take which is based upon or relates to any of the questions and/or answers on the Site.
12.11 RQ has no responsibility to monitor You or any other user in order to ensure that You abide by these Terms and Conditions. However, RQ has the right to do so and if RQ suspects that the Site is being misused in any way then RQ may at its sole discretion take all necessary measures in order to close the account. You have no right to any form of compensation from RQ in the case that You and/or any third party misuses the Site.
12.12 RQ is not liable for any damages against You or a third person for any damages that has occurred by You using the Site. All usage of the Site is completely at Your own risk.
12.13 RQ may at any time and without notice to You, turn off the Site, make changes to the Site, and recall or change all or any offers, prizes and/or competitions. RQ is not liable for any loss or damage suffered or incurred by You that comes from or relates to anybody obtaining access to Your account.

13. Disputes
13.1 These Terms and Conditions are subject to and shall be governed and construed in accordance with Swedish law and any disputes regarding these Terms and Conditions shall subject to the exclusive jurisdiction of the Swedish Courts.
13.2 In the event that any provision of this Agreement shall be determined to be illegal or unenforceable in any jurisdiction by a court of competent jurisdiction , then the allegedly illegal or unenforceable provision shall be amended, limited, eliminated or otherwise changed by RQ to the minimum extent necessary so that it is no longer illegal or unenforceable and so that it as nearly as possible meets its intended commercial effect but without being illegal or unenforceable and the other terms and conditions in this Agreement shall remain in full force and effect and enforceable.
